Funding Water Safety & Fighting Invasive Species ………..……........ for 2007 and beyond

Water safety law enforcement has been under-funded on the Iowa Great Lakes for twenty-five years. Fighting Aquatic Invasive Species is a relatively new development, but never the less, a real threat to lake water quality deserving our attention. Funding for water safety and fighting invasive species have been a major concern of the Water Safety Council.

In 2005, our state Representative Mike May and Senator David Johnson introduced legislation to increase boat registration fees with the new revenue dedicated to water safety and fighting invasive species. This legislation passed the House and Senate in April 2005 and was signed by the Governor. The increased fees will go into effect this spring.

The boat registration fee for 92% of Iowa boats will increase by $2 to $6 per year. Although a few dollars per boat doesn’t sound like much, when it is multiplied by Iowa’s 230,000 boats it will generate $960,000 of annual funding for water safety and fighting invasive species.

This new legislation will also increase the boat registration period from two to three years. This means that although your new boat registration fee will seem like it increased by more than a few dollars, you will not have to renew your boat registration as often.

The new law - Iowa Code section 462A.52 - specifies that boat registration fees must be spent on water safety and fighting invasive species. In addition, the Department of Natural Resources must now annually report to the legislature the source and amounts of all funds spent on water safety and fighting invasive species. The first report is due December 31, 2007 and each year thereafter until 2013.

For 2006, the DNR did increase spending for water safety on the Iowa Great Lakes. With the increased boat registration fees going into effect this spring – and an appropriate allocation of these resources - funding for water safety and fighting invasive species should begin to reach a more appropriate level than where it has been in the recent past.

Boat Nighttime Speed Limit Approved For Dickinson County

On March 9, 2006 the DNR Natural Resource Commission approved the boat nighttime speed limit

The Commission amends Chapter 40, “Boating Speed & Distance Zoning” Iowa Administrative Code. ..................

The department was petitioned by the East Okoboji Lakes Improvement Corporation to establish a one-half hour after sunset to sunrise speed limit for vessels operating on all lakes in Dickinson County. Notice of Intended Action was published in the Iowa Administrative Bulletin on January 4, 2006, as ARC4794B. ................

Comments were received during the comment period for the nighttime speed limit on all lakes in Dickinson County electronically; by mail; and verbally at the public hearings held in the Wallace Building and locally at Arnolds Park. The majority of the comments were in agreement that a nighttime speed limit should be established. No changes have been made from the Notice of Intended Action. Pursuant to the authority of Iowa Code subsection 455A.5(6), the Natural Resources Commission adopts amendments to Chapter 40, "Boating Speed and Distance Zoning," Iowa Administrative Code. 

The following amendment became effective May 3, 2006:

Amend 571—Chapter 40 by adopting the following new rules:

571--40.52(462A) Nighttime Speed Limit, Dickinson County. No vessels, except authorized emergency vessels, shall be operated at speeds greater than twenty five miles per hour at any time between the hours of one-half hour after sunset and sunrise on all lakes located in Dickinson County.
